Musicians reserve the right to sell promotional merchandise including, but not limited to, Tapes, Compact Disks, T-Shirts, Sweatshirts, Hats, and Bumper Stickers. Musicians will retain full proceeds from all merchandise sold. Musicians will be provided with an area within the venue to sell merchandise and provide mailing list and fan information. -Musicians are allowed a guest list of up to (number of guests) ______________________. Guests may be admitted by either VIP pass or by inclusion on guest list provided by musicians. 9. Musicians are deemed non-liable for breach of contract due to sickness, accident, strikes, civil turmoil, epidemics, mechanical malfunctions, acts of God, or conditions totally beyond the control of the musicians. 10. This contract, and the terms and conditions stated herein, may be enforced by the Purchaser, and its agents, and by each musician who is party to this contract or whose name appears on the contract or who has, in fact, performed the engagement contracted for (herein called "Participating Musician(s)"), and by the agent(s) of each participating musician. This contract can be void by written consent by both Purchaser and Musician(s). 11. Resolution of controversies or claims: Any Controversy or Claim arising out of or relating to this contract, or breach thereof, shall be submitted for arbitration to the American Federation of Musicians; American Arbitration Association; or city, state, or federal court system.
